Qualified Electronic Signature (QES)
About
Qualified Electronic Signature (QES)
A Qualified Electronic Signature (QES) is the most secure and legally binding form of digital signature, offering the highest level of trust and legal recognition under the eIDAS Regulation. It is the only type of electronic signature that has the equivalent legal effect of a handwritten signature in all EU member states and many other jurisdictions.
Best Use Cases for QES
QES is essential in contexts where maximum legal certainty, strict identity verification, and regulatory compliance are required, such as:
-
Signing contracts with government bodies or in public procurement
-
Cross-border agreements within the EU or with international partners
-
High-value transactions, such as real estate, financial, or insurance contracts
-
Court documents, HR documentation, and regulated industries like healthcare and banking
How It Works
QES relies on a qualified digital certificate issued by a Qualified Trust Service Provider (QTSP) and includes a secure signature creation device (QSCD).
The process involves:
-
Face-to-face or remote identity verification (e.g., via video identification)
-
Use of qualified certificates that securely link the signatory's identity to the signature
-
Signing via a hardware token, smartcard, or secure app linked to the certificate
-
Full compliance with eIDAS, ensuring cross-border legal validity
Advantages of Qualified Electronic Signature
-
Maximum Legal Standing
QES is legally equivalent to a handwritten signature under eIDAS, offering full enforceability in court and across jurisdictions. -
Highest Security and Identity Assurance
Strong identity checks and secure cryptographic mechanisms ensure signatures are authentic and unalterable. -
Cross-Border Recognition
Accepted throughout the EU and recognized in many other regions—ideal for international transactions. -
Non-Repudiation and Compliance
QES provides clear, auditable proof of identity and intent, reducing the risk of legal disputes and ensuring compliance with GDPR, eIDAS, and industry regulations.
